1. General
These terms and conditions govern all waterjet cutting and related services provided by Part Engineering (“we”, “us”) to the customer (“you”). By placing an order or requesting a quote, you agree to these terms.
We reserve the right to update these terms at any time. The version in effect at the time your order is accepted will apply to that order.
2. Quotes and pricing
All quotes are valid for 30 days from the date of issue unless otherwise stated. Quotes are based on the information and drawings provided at the time of quoting. Any changes to material, quantity, geometry, or specifications may result in revised pricing.
Quotes are provided in Australian dollars and exclude GST unless stated otherwise.
3. Orders and acceptance
An order is accepted when we provide written confirmation (email is sufficient). We reserve the right to decline any order at our discretion.
Customer-supplied drawings or DXF files must be provided in a compatible format prior to commencement. We are not responsible for errors arising from incorrect or unclear drawings supplied by the customer.
Any changes requested after an order is accepted may incur additional charges and affect lead times.
4. Material
Customer-supplied material: You are responsible for ensuring material is suitable for waterjet cutting, correctly specified, and delivered to us in adequate condition. We are not liable for defects, inclusions, warping, or residual stress in customer-supplied material that affect cut quality or yield. Excess material consumed due to material defects will be charged at cost.
Part Engineering-supplied material: Where we supply material, pricing will be included in the quote. Material remains our property until full payment is received. We source material in good faith; minor variation in grade certification or dimensions within standard tolerances is not grounds for rejection.
In either case, offcuts and scrap material resulting from the cutting process remain the property of Part Engineering unless otherwise agreed in writing.
5. Tolerances and cut quality
We make every effort to cut as closely as possible to the supplied drawing. Our standard cut quality is Q3 (on a scale of Q1 to Q5). Where no tolerance is specified on the drawing or in the order, a general tolerance of ±1mm applies.
Tighter tolerances may be achievable and must be agreed in writing prior to commencement. Where specific tolerances are provided by the customer, we will make all reasonable efforts to achieve them, with any special requirements reflected in the quote.
Material thicker than 50mm: For material exceeding 50mm in thickness, the nature of waterjet cutting means that certain characteristics are inherent to the process. These include jet taper on the cut face, potential loss of squareness on the side profile, and surface ridging, particularly toward the exit face of the cut. We take all reasonable steps to minimise these effects, and where a customer has specific requirements regarding side wall quality or squareness, this must be communicated prior to quoting so the appropriate cut parameters and quality level can be applied. Tolerances for thick material are agreed on a job-by-job basis.
6. Lead times
Estimated lead times are provided in good faith and are not guaranteed. We will notify you promptly if a delay is anticipated. We are not liable for losses arising from delays outside our reasonable control, including equipment breakdown, material supply issues, or unforeseen operational circumstances.
7. Payment
New customers: Payment is required in full prior to delivery or collection of completed parts. Work will not be released until payment has been received and cleared.
Existing customers: Payment terms are as agreed and stated on the invoice, either net 30 days end of month or due within 7 days of delivery, depending on the arrangement in place.
Overdue invoices may attract interest at 2% per month. We reserve the right to withhold completed parts or suspend future work until all outstanding amounts are paid in full.
We accept bank transfer (EFT). Other payment methods by prior arrangement.
8. Collection and delivery
Parts are available for collection from our premises once payment has been received. Where delivery is arranged, freight costs are the responsibility of the customer unless otherwise agreed.
Risk in the goods passes to the customer upon collection or handover to a freight carrier.
9. Liability and part performance
Part Engineering provides a cutting service based on drawings and specifications supplied by the customer. It is the customer’s sole responsibility to verify that the design, material selection, dimensions, and tolerances specified are suitable for the intended application. We do not accept any responsibility for the performance, fitness for purpose, or failure of parts in service.
Any part failure, structural inadequacy, or downstream consequence arising from the design, material properties, or intended use of the cut parts is entirely the responsibility of the customer. Customers are advised to carry out their own inspection, testing, and verification of all parts prior to use.
That said, we take every reasonable step to ensure that all cuts are completed to the standard agreed at the time of quoting. If any issue arises with the quality of our cutting work, we will take all reasonable steps to investigate and rectify the problem promptly.
Our liability is limited to the value of the affected order. We are not liable for indirect, consequential, or economic loss including loss of production, loss of profit, or third-party claims.
10. Intellectual property
All drawings, DXF files, and design data supplied by the customer remain your intellectual property. We will not share or use your files for any purpose other than fulfilling your order.
Any toolpaths, nesting layouts, or programming created by us to fulfil your order remain our intellectual property.
11. Governing law
These terms are governed by the laws of Western Australia. Any disputes will be subject to the jurisdiction of the courts of Western Australia.
